Argues that by creating a mediation-style dispute resolution service, the Technology and Construction Court (TCC) is merely responding to the demands of construction clients, by providing them with a judicial evaluation before becoming locked into a formal court battle. Experience of similar systems in the USA and Europe shows that concerns about judges acting as mediators are probably misplaced. Also provides a brief guide to TCC mediation procedure.
