Argues against the practice of novation, whereby a specialist design team transfers the risk of its design liability work to design-and-build contractors, who then either attempt to pass on the design risk to sub-contractors or novate the design team to one or more of the sub-contractors. This practice can and often does lead to inefficiency, additional costs and disputes. A far better method is for the appointment of an inclusive design team at the outset of a project, so that all parties own the design and risk management decisions.
