Comments upon "Maggs v Marsh" ([2006] EWCA Civ 1058, L134669). The decision emphasises that whereas subsequent conduct cannot be taken into account in interpreting the terms of a written contract, it is perfectly permissible to use such evidence where the contract is wholly or partly oral.
