Tenancy defined - 2006 - Solicitors' Journal 150(34) 8 September 2006, 1144-1145(2) .

Discusses the situation whereby a person occupies a residential property without paying rent, but is offered exclusive possession for a specified period in return for maintaining the property. Questions whether such a person is considered a tenant or a licensee. Concludes that if the occupier is performing a service for the landlord for which it is necesssary to live on site, then the occupier is considered a service occupier and is therefore a licensee. If the duties could have been performed without living in the property, then the occupier would be a tenant.
