[2006] EWCA Civ 1392, 26th October 2006. The registered proprietor of a property appealed against the claim by a squatter that she had a right to the freehold of the property by adverse possession, having lived in the property for 12 years. "Held": the existence of a sham lease drafted by the respondent in December 1991 and sent to the appellant's solicitors acknowledged his ownership of the property for the purposes of the 1980 Limitation Act. As such the respondent could not claim the property through adverse possession as the 12 years necessary to comply with the Land Registration Act had not passed.
