[2006] UKHL 52, 6th December 2006. The appellant appealed against a decision ((2001) EWCA Civ 1766, (2002) Env LR 25) that the Town and Country Planning (Assessment of Environmental Effects) Regulations 1988 had properly implemented Council Directive 85/337 into domestic law. The appellant lived in the vicinity of Crystal Palace Park in London and protested against proposed developments on the site arguing that an environmental impact assessment would have been required. "Held": By precluding any consideration for the need for an environmental impact assessment at the stage when, following the grant of an outline planning permission for a development, consideration was being given to an application for the approval of reserved matters, the Town and Country Planning (Assessment of Environmental Effects) Regulations 1988 failed fully and properly to implement Council Directive 85/337.
