[2007] EWCA Civ 4, 12 January 2007. Concerned a dispute over the ownership of certain land. The appellant appealed against the dismissal of his appeal against a decision of a county court judge granting the respondent college summary judgment in respect of its claim for specific performance of a compromise agreement. The appellant argued that he already owned the land in question at the time the compromise agreement was made through adverse possession. "Held": it was decided that the appellant could not make such a claim as he did not make any mention of it at the time of the original agreement.
