Discusses the revised PLA dilapidations protocol (E135069), querying why the Department of Constitutional Affairs (DCA) has not yet adopted it and highlighting continuing problems for commercial landlords and tenants, their surveyors and lawyers. Proposes a number of changes that may encourage its adoption, including joint appointments, joint site meetings with landlord and tenant surveyors at the start of the claim, using a third surveyor, and formalisation of the dilapidations resolution process within the lease. Concludes that dilapidations surveyors should continue to debate the content and effect of the protocol prior to the DCA approving it.
