Considers the limitations of the Contractor's All Risks Insurance or Works policy. Notes that All Risks policies generally cover physical damage, as opposed to defects, and that the cover provided is limited in terms of its duration and therefore excludes latent defects. In addition, All Risks contains significant exclusions in the form of the Design Exclusion clause. Looks at the five different types of Design Exclusion clauses, DE1 to DE5, and concludes that such gaps in cover can be partly filled by professional indemnity insurance, provided that negligence is established.
