Shows how this cover works for the civil engineering industry by referring to the case of "CA Blackwell v Gerling Allegemeine Verischerungs AG" ([2007] EOHC 94 (Comn), unreported) where B wished to recover the costs of damage to roadworks due to rain. G had argued that an all risk policy was against risks of loss and not causes of loss. States that under all risk insurance the party must prove that its loss was fortuitous and within the policy's time period.
