Discusses a case [2007] 17 EG 174, where the claimant, the freeholder demised to the tenant for 20 years, and the tenant served notice to exercise a break clause terminating the lease at the end of its 10th year. The claimant served a schedule of terminal dilapidations in respect of the tenant's repairing covenants. "Held": the deed of assignment had not terminated the tenant's liability. Upon expiry of the lease, the tenant was liable with respect to the breaches of covenant and was entitled to be indemnified by the defendant in respect of those liabilities.
