[2007] EWHC 895 (Ch), 23 April 2007. Considers whether a company's error in failing to challenge a figure applied to the selling of land can be rectified by the court. Also considers whether a claim of dishonesty can be made against a land valuation which is considerably inaccurate. The price of land derived by a formula was agreed by both parties and it was only subsequently appreciated by the claimant that this was an inaccurate valuation, and that some clauses of the formula ought not to have been agreed to. The defendant had also made a claim as to the net value of the land which was shown to be lower than stated. "Held": It was found that the court could not correct a contract which was agreed to by both parties. It was found that the price of price of the land in question had been misrepresented by the defendant and that the claimant could recover damages.
