Discusses the effects of Scottish and Newcastle plc V Raguz (L137096). Predicts a plethora of unnecessary notices being served by landlords on tenants. Landlords have previously served section 17 notices on former tenants if the current tenant defaults. Following this judgment they will need to do decide whether to do this within six months of each rent due date while a rent review remains outstanding, or lose the right to claim the lost rent. A similar approach may be required with service charge payments. Landlords may choose to serve variable, zero amount notices in case of future determined increases.
