A practical understanding of the law part 5

A practical understanding of the law part 5 - 2007 - Facilities Management 14(9) June 2007, 16-17(2) .

Examines the certainty precept and the principles on delivery of, and payment for, goods and services. Disputes arise from the question of what is sufficient certainty in contract. Spelling out the terms of an agreement is a narrow yet well established approach, co-existing with a more realistic and commercially oriented approach. This might mean reference to more open contract clauses, or to previous agreements between the same parties. Considers conditions where services supplied may be unacceptable. Provides advice for facilities managers, and recommendations for fulfilling contract. Refers to landmark case law.
