QBD, 17 July 2007. How a landlord narrowly avoided liability for its tenant's cleaning policy. A man who slipped on a petal outside a flower shop as he walked across the forecourt of a train station, seriously injuring himself, sued both the tenant of the flower shop, and the site landlord, for negligence. Held: the flower shop owner was negligent in not having a proactive system for clearing up messy petals. The claim against the landlord was dismissed. However, the court stated that the landlord could have done more to oblige the tenant to maintain higher standards. Case shows that to avoid liability for claims, landlords would be advised to make sure that they properly enforce the obligations of their tenants.
