Suggests strongly that mortgage fraud is not limited to the legal profession but also affects valuers. Discusses the case of Nationwide Building Society v Dunlop Haywards Ltd [2007] EWHC 1374 (Comm); [2007] 07 PLSCS 181. Following a series of valuations carried out by a director of Dunlop Haywards (DH), Nationwide lodged an unusual claim for damages for deceit rather than conventional claim for negligence or breach of contract. As the defendant was under criminal investigation, Nationwide also applied for a rarely given summary judgement, thereby also pre-empting a defence of contributory negligence. Held: summary judgement justified. Damages said to be about £27m, but remains unconfirmed as the case was settled on the day judgement was to be handed down.
