Corner and others v Salford CC [electronic resource] - 2007

[2007] EWLands ACQ_99_2006, 9 May 2007. Considers the amount to be paid in respect of the compulsory purchase of a domestic property. Salford City Council had made efforts to contact the freeholder, Mr Corner (C) and the chargees, Ms Corner and Mr Kormornick. Efforts to contact these had been unsuccessful and evidence was supplied. The District Valuer assessed the open market value of the freehold at a level based upon similar properties in the street, and their recent sale prices. The Council requested that it be permitted to make payment to court in the absence of any interested parties. "Held": The valuation of compensation to be paid was accepted. The request to pay this into court was not accepted because a notice to treat was deemed to have been served under the Compulsory Purchase (Vesting Declarations) Act 1981.
