In the situation of redeveloping a property, explains how to handle deeds with rights to light. Suggests seeking legal advice on the terms of the deed, explains how prescriptive rights to light are acquired, and considers provisions similar to those in "RHJ Ltd v FT Patten (Holdings) Ltd" ([2007] EWHC 1655 (Ch), L139811). Also advises that investigations concerning the property and relevant neighbourhood buildings are carried out to identify any other rights to light issues. In addition, a rights to light surveyor may be needed to identify any buildings that are in the process of acquiring prescriptive rights under the Prescription Act 1832.
