The law's an apse

Naylor, James

The law's an apse - 2007 - Estates Gazette (2) 26 October 2007, 1500-1501(2) .

Describes Chancel Repair Liability (CRL) and argues that it is arcane in nature and should be abolished. CRL is a liability to repair church chancels when land is purchased from the Church of England. It is enforceable by Parochial Church Councils which are able to instigate proceedings for recovery of repair money. Uncertainty surrounding the issue renders a number of homes unsellable. There are some 5 200 CRLs affecting over 4 000 private landowners. They are not capped and it is often difficult to establish their extent. Insurance is one solution, since recent legislation provides little protection from CRL litigation.
