Reports on the increasing use of Town or Village Green (TVG) applications to prevent developments. Application to register land as a TVG can be made by anyone if it has been used for recreational purposes for over 20 years. To defeat this, landowners need to disprove claims that force, secrecy and landowner permission have all been absent. The erection of fences can be one solution if they remain as a barrier. Compares the rules with those enforced by the Rights of Light Act 1959. Suggests an improvement to the legislation allowing public use without implying availability for development.
