Considers that disputes between developers and builders, including defects with a finished building or the net lettable area falling short, are costly and time-consuming. Suggests that developers can now force building contractors to compensate them for time wasted on disputes thanks to decisions in two court cases in 2007. Finds developers are using these rulings as leverage to gain higher settlements, even when the dispute is resolved by negotiation. (See also L137083 and L138769).
