[2007] EWLands ACQ_6_2006. The case concerned how much compensation was due following a compulsory purchase of commercial property for which, Chartered Surveyors gave expert valuation evidence. A council compulsorily purchased of a block of retail and office/storage units in connection with a proposed city centre regeneration project. The court had to decide: the effect of the proposals on rental values; whether prospects and delays in implementing the impending scheme had impacted negatively on growth; the appropriate rental value in light of this; the yield rate to be applied to capitalise the net rents received and receivable; loss of rental income; appropriate compensation for empty rates; pre-reference costs.
