Considers the legal problems associated with brownfield development. The government aims to build 60% of new housing on such sites. Developers are also considering the sites due to the lower prices and higher availability. However a lack of clarity in statutory guidance over land remediation methods has caused legal problems, rising costs and delays. DEFRA published further guidance in 2006 which is still awaiting implementation. Developers are forced to await this new guidance or work under the current unsatisfactory guidelines. Reports problems with soil guidance values, generic assessment criteria aimed at assessing risks from contamination.
