[2008] UKHL 12, 20 February 2008. Appeal by contractor (B) against a decision ([2007] EWCA Civ 601, L143128) that B had not been entitled to determine a JCT contract made between B and respondent employer (R) because R had withheld a sum due in payment. "Held": appeal dismissed. R was entitled to deduct from the payment certificate a sum representing damages for non-completion, even when the certificate of non-completion had been cancelled by the subsequent grant of an extension of time.
