[2008] EWHC 45(QB)(QBD). The case shows that a tenant cannot expect, on a lease renewal, to be given more rights than those already granted. The case concerned whether a right to parking spaces which, were not part of an agreed business tenancy but by a letter of assurance, could be part of a renewed tenancy agreement. Held: the court had a discretion to include a personal right in the new lease, it was not appropriate in this case. The original lease made no provision for external parking and the tenant had not established a case to have terms giving parking rights included in the new lease. Appeal dismissed.
