[2008] 145(Ch). This case is a reminder that the courts have the power to limit vibration caused by construction works. The case concerned the balance of inconvenience in a private nuisance action for a claimant (H) seeking an injunction to prevent excessive noise and vibration caused by demolition works next door carried out by the defendant (P) to build a new office block in the City of London. H wanted the injunction to set limits on nuisance, especially vibration levels. Held: injunction granted. An obligation to use all reasonable or best endeavours is more onerous than an obligation to use reasonable endeavours. An excesses of vibration levels can be a criminal offence.
