Discusses the case of Brooks and another v Young and another [2008] CA (Civ Div). The Court of Appeal had to decide whether or not the terms granted in a right of way to a householder should be interpreted in such a way as to limit its use and prevent the neighbouring householder from being disturbed. The appeal was allowed because the court of first instance had interpreted the right of way in an overly restrictive way.
