[2008] EWLands LCA_102_2006 28 January 2008. Claimants L brought a case for compensation in respect of the impact of a road improvement scheme (building a wall) upon their property against respondent T. T produced evidence that a payment had already been made by the Highways Agency as regards entering the property to maintain the wall and that there was no requirement to issue further compensation. Held: an agreement to acquire the right to enter the land for the purpose of erecting a wall was established with documentary evidence and L had no claim under the Land Compensation Act 1973.
