Discusses the problems that can arise in project team partnering which are often part of construction contracts. Defines partnering and notes the main partnering contracts. Using a worked example, explains how disputes may arise and how problems and disputes can be avoided. Considers whether the duties to co-operate or duties to act in good faith can make a practical difference. Comments on dispute resolution provisions in partnering contracts and suggests how disputes may be both avoided and resolved. Concludes that while partnering may be valuable it is not a panacea and that it is still necessary to consider how any possible dispute might be resolved.
