LTS/TC/2007/02 22 August 2007. Concerned the variation or discharge of a title condition which was an ongoing building restriction contained in a Feu Contract of 1933. The applicants wanted to extend their bungalow at ground and roof level, for which they had been given planning consent. The respondent was an immediate neighbour who was opposed to the extension at roof level. "Held": the conditions should be varied so that the development can go ahead, and the respondent's claim for compensation was refused.
