Summarises the case of William Old International Ltd v D Arya and another, HC (Ch), 20 April 2009. Case centres on whether an easement to lay cables under a property owner's land implied that the owner was required to enter into a deed with the utility company laying the cables. It was held that the easement did not carry with it an implied positive obligation on A to execute the deed nor did A's refusal to execute the deed constitute derogation from the granting of the easement.
