Concerned an application under the Title Conditions (Scotland) Act 2003 S90(1)(a)(i) to discharge a servitude right of access across the applicants' property to the respondent's property, which is a modern house built near of the applicants' on land sold by the previous owners of the applicants' property. The respondents opposed the application. "Held": application granted, on the condition that signage is provided directing visitors to the new entrance.
