The case relates to the seeking by the Claimant (B) of an order under the Town and Country Planning Act 1990 S288 to quash a Woodland Tree Preservation Order (TPO) made by the Defendant (C) in respect of an area of woodland. D had previously worked for C as an arboricultural Officer and was against the imposition of a TPO by C. The Court has to consider whether B could be classed as an "aggrieved" person under S288 and therefore had a right to bring a claim. "Held": Claim dismissed. B is not an "aggrieved" person under S288 of The Act.
