[2009] EWCA Civ 852, 31 July 2009. Concerns issues related to gaining possession of a property that is the subject of a demoted tenancy. The order for possession was made by Manchester City Council (M) under the Housing Act 1996 S143D as amended by the Anti-Social Behaviour Act 2003. The appellent (P) was tenant of a property for 30 years, but his tenancy had been changed to a demoted tenancy because of the anti-social behaviour of his sons.
