Concerned an application under the Title Conditions (Scotland) Act 2003 S34(3) and S90(i)(c) relating to the respondents' proposals to discharge conditions to allow them to build a new property in their garden. The applicants (their neighbours) opposed this. "Held": application allowed: the conditions should not be discharged without having any safeguards in place.
