Surveyors facing claims from mortgage lenders unable to realise the value at sale of repossessed properties may be able defend their position by claiming contributory negligence. A bad lending decision can enable the surveyor to defeat a claim entirely or achieve a substantial reduction in any damages awarded. Then of course, the next step is to investigate how much of the claim can be passed onto the lender's solicitor and the mortgage broker.
