"Draycott v Hannells Lettings Ltd" [2010] EWHC 217 (QB) (E149615) clarifies the penalty provisions of the Housing Act 2004 Chapter 4 relating to the protection of tenancy deposits for non-compliance. A landlord's agent is liable for any failure to register a deposit but late compliance will not automatically attract the penalites set out in s214 of the 2004 Act.
