Standard Life Investments Property Holdings Limited v W & J Linney Limited - 2010

[2010] EWHC 480 (Ch), 25th February 2010. Highlights the failure to properly exercise rights to terminate commercial leases, wherein the common law provides that a notice to quit must be given to the immediate landlord. Considers whether the defendant L had given notice to operate a break clause in a lease to the correct landlord, Capita or the plaintiff S to whom Capita had granted an overriding lease effectively making S L's landlord. Held: L sent a break notice to Capita which it thought was its landlord whereas S was the overriding landlord. Judgment against L as it had served its break on the wrong landlord.
