In Norwich Union Life Insurance Society v British Railways Board , ChD 9 June 1987, the court held that a repairing covenant in a 150-year commercial lease , imposing an obligation on the tenant "when necessary to rebuild reconstruct or replace" the premises went beyond the normal obligation to keep the premises in good repair and an arbitrator was entitled to make a downward adjustment when reviewing the rent.
