Claimants (P) are the landlords of premises in Tottenham Court Road in central London. Defendant (K) was granted a tenancy in 2004 under a 20 year lease. P served K with a notice under the Law of Property Act 1925 s146 to forfeit K's lease because of immoral use, the breach being irremediable. "Held": CA granted K relief from forfeiture as it was not running the brothel. K's lease with P stopped the building being used for immoral purposes. K had to pay costs at it had waited until the court case before remedying the matter.
