Q failing to negotiate a new lease from S sought assignment of LD?s existing lease. S proceedings against Q for possession of the property as LD?s lease had been surrendered by operation of law were upheld by CC. Q appealed. ?Held?: CA found for Q. The LD lease had not been surrendered so Q who was not a tenant at will could not be forced to leave.
