[2011] EWHC 403 (TCC), 23 February 2011. Determines whether the guarantors of a poorly drafted lease had a substantial liability for the repair of windows. Claimant (P), the owner of a converted mill in Leeds sought claims for dilapidations in respect of repairing windows against the defendant guarantors (W and P) of an expired lease in that property . W and P contested their liability. "Held": High Court found for the defendants. The deed of variation entered into by the defendants with effect from 17 November 2007 had the intention to protect the defendants from the repairs.
