[2011] EWCA Civ 554 19 May 2011. This case relates to an appeal by a tenant, TG, against a previous award of damages against her landlord, PG. The damages were in relation to mould and damage to plasterwork caused by water ingress which had not been repaired by PG. The previous judge had discounted the damages by 90% on the basis that the damage was primarily caused by structural elements outside the responsibility of PG and that internal plasterwork is not part of the structure of a building for which PG was responsible. "Held" The plastwork does represent part of the structure of the building, and the damages were therefore increased.
