[2011] EWCA Civ 602, 19 May 2011. Relates to an appeal by I against an order for possession made against him in the County Court. I had lived in the property since 1994: the respondent, K was the freehold owner. The claim for possession was made due to arrears of rent. I counterclaimed that the repairing covenants had been breached. "Held": the appeal was allowed and the claim for possession was set aside. The case was remitted to the County Court to reconsider the claim for possession on the basis of it being an assured rather than and assured shorthold tenancy.
