Discusses CA's interpretation of the Electronic Communications Code regarding compensation payable to landlowners by telecommunication operators for installation and retention in "Blackwater Canal Company Ltd v Geo Networks Ltd" [2010] EWHC 548 (Ch). Explains how the Code distinguishes between ordinary landowners (general regime) and other landlowners mostly infrastructure providers such as highway authorities, rail and canal companies described as special regimes. "Blackwater" fell into the special regime category. Law Commission is reviewing the code in light of "Blackwater" and is due to publish its recommendations in 2013.
