[2011] EWCA Civ 929, 29 July 2011. Considers whether the standard limitation on terminating a contract for misrepresentation is reasonable. Respondent S agreed terms with appellant C in 2007 for the sale of a potential development site. C contended that S tried to back out of its agreement to purchase after the disclosure of a second application from another potential purchaser and because of a fall in the property market. C appealed. "Held": Appeal dismissed. S was allowed to terminate its purchase because the second, originally undisclosed, application affected S's own plans.
