Frozen Value Ltd v Heron Foods Ltd [electronic resource] - 2012

[2012] EWCA Civ 473, 24 April 2012. Concerns landlord H's opposition to tenant F's application for a new business tenancy under part 2 of the Landlord and Tenant Act 1954. H had been granted a new head lease by the freeholder K but opposed the subleaser F's application for tenancy as it intended to occupy the premises itself, invoking the statutory ground of opposition known as "ground (g)". F appealed against this opposition. "Held": appeal upheld. H could not oppose the application as it was not the "competent landlord" for the last 14 months of its headlease.
