[2012] EWHC 884 (Ch), 4 April 2012. Considers whether a landlord owes any duty to assist a tenant to exercise the break correctly. Tenant claimant P served a break notice on the defendant landlord C. C demanded rent due for the whole quarter two weeks before the break data. Thinking that it only had to pay rents up to the break date P wrote to C to get confirmation but C failed to reply before the break date passed. P contended that C owed it a duty to point out its error. "Held": found in favour of C: C had no such duty. P chose to take the risk of only paying up to the break date.
