[2012] EWCA Civ 607, 9 May 2012. Overturns a judgment allowing a sublease to be rewritten to give effect to what the judge thought the parties really intended. Respondent S sublet premises in London's Docklands to appellant B agreeing to subsidise the difference between the market rent and its rent liability for a period. The sublease led to a shortfall in the rent payable to B. S contended that there was a mistake in the sublease draft. "Held": appeal allowed. CA rejected S's rectification claim and found S liable for the shortfall.
