[2012] EWCA Civ 1338, 17 October 2012. CA clarifies whether a contract will be automatically unenforceable because of illegality. Claimant P contractually provided an automated monitoring and control system for 17 of defendant S's car parks. P sued S for breach of contract as S terminated a contract after only six months. S claimed that the contract was void because P deployed unlawful means to collect some of the parking charges. "Held": CA dismissed S's appeal: the contract was valid as the unlawful act related to only a small part of the contract.
